Placing Orders You are responsible for all orders placed on your account, including for any discrepancies or errors in your order caused by you. The promotion of goods or services on the Website does not constitute an offer to sell. It is an invitation to treat only. Orders placed by you are offers to purchase either: goods under the terms and conditions in this Agreement at the price specified (including delivery and other charges). Goods in your cart are not reserved until you have completed the checkout process. Orders are only confirmed once payment is received in full. The stores may reject your order, including in circumstances where they believe there may be a credit card fraud, or where they later become unable to ship your order, or if there has been an error in the price or product description on the Website. You must review your order carefully before placing it. Once an order is confirmed, you are unable to cancel or change it. You will have to call the store contact provided to make changes, or go in store. If you have any problems with your order, then you must go through the normal returns process outlined in their Agreement. Please note that change of mind returns are given at their absolute discretion. As a general rule, they will not change or replace your order where you have made an error. In the event that they cancel or are unable to fulfil your order, they will provide a full refund of any payment received.

Price, Payment and Use of Discount/Coupon Codes The prices of goods, delivery and other charges shown are in Your country's currency and the currency accepted by the store. All payments must be received in full prior to dispatch of goods. If your payment is not received or is declined by the store, your bank or credit card issuer, they cannot and will not hold items against your order. Store Credits Any unused portion of your Store Credit shall be credited to your account. To the extent permitted by law, The Stores reserves the right to change any of the terms and conditions in relation to its Store Credit upon the provision of reasonable notice, including by notice on the Shoppersmist Website.Store credit issued in lieu of a refund will expire according to the store policy on that from the date of issue. Supply and Delivery of Goods Subject to this Agreement, the store will supply the goods shown on your order confirmation. Software and Technology Purchases – Limitation of Liability You acknowledge that storage media such as hard drives in laptops, external hard drives, SD cards and USB keys can fail without warning, leading to a loss of data. You should regularly back up software stored on the media. In the event that storage media ordered from us becomes faulty, fails or otherwise detrimentally affects software or data stored on it, except as required by law, we will not be liable for any loss or damage to the software or data If you return storage media (such as a hard disc drive) whether separately or as a part of another product, to us for any reason, including replacement or repair, we will not be responsible for any software or data stored on the media. We make no representation that we will be able to repair or replace any product without risk to or loss of the software or data.

Goods Out of Stock Check the store policy for goods out of stock. Defective Goods If goods come with guarantees that cannot be excluded under the Consumer Law in your country of origin, you are entitled to a replacement for or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. Goods that you purchase may contain warranty documents on or inside the packaging provided by the manufacturer of the product. Any such warranty documents are not given by Stores, check store policy for that. Some warranty documents provided by manufacturers of imported goods may not apply in your country. You should contact the manufacturer identified on the warranty document to determine whether or not the warranty applies to the goods in your country, and, if so, how you should go about making a claim under such a warranty.

Process for Returns and Refunds When seeking a return on a product, please contact the store Help Centre. Once contacted they will investigate your issues and advise you whether your product may be returned and, where required, provide you with a Return Authorisation and instructions on how to return your goods, with which you must comply. Once an item is returned they will either inspect your goods and investigate any claimed defect or, where they believe it is applicable, provide a remedy in relation to your goods. If they do not believe a remedy is applicable upon inspecting your goods (for example, where they believe the goods have been misused, or there was a failure to use in accordance with manufacturer's instructions, used it in an abnormal way or there has been a failure to take reasonable care), they will reject your claim and return your goods to you. You must cover the cost of return shipping in order to receive goods they have rejected on inspection, and they will provide you with instructions on how to make this payment, or you can arrange pick up, check store policy that apply. Refunds will be issued using the payment method used for purchase. Store credits will be issued to the account used to purchase the goods. Check store policy for accurate policies accepted.

 (a) modify or copy the layout or appearance of the Website nor any computer software or code contained in the Website; and/or (b) decompile or disassemble, reverse engineer or otherwise attempt to discover or access any source code related to the Website. If you correspond or otherwise communicate with us, you automatically grant to us an irrevocable, perpetual, non-exclusive, royalty-free, world-wide licence to use, copy, display and distribute the content of your correspondence or communication and to prepare derivative works of the content or incorporate the content into other works in order to publish and promote such content. This may include, but is not limited to, publishing testimonials on our Website and developing your ideas and suggestions for improved goods or services we provide.

If we do not exercise or enforce any right or provision under this Agreement, it will not constitute a waiver of such right or provision. Global Marketplace: Some of Shoppersmist features may display your ad on other sites that are part of the global Shoppersmist community, on our classifieds sites in other countries. By using Shoppersmist you agree that your ads can be displayed on these other sites. The terms for our other sites are similar to these terms, but you may be subject to additional laws or other restrictions in the countries where your ad is posted. When you choose to post your ad to these countries, you may be responsible for ensuring that it does not violate the required policies. We may remove your ad if it is flagged on our sites, or if we believe it causes problems or violates any law or policy.

Fees and Services:  Using Shoppersmist  is generally free for customers and Vendors but we charge a fee to vendors for creating their store on our site and for advertisements as well, but registration and certain features on Shoppersmist are free for Vendors. We may charge fees for certain services. If the service you use charges a fee, you will be able to review and accept that charge. Our fees are quoted in American  Dollars USD, and we may change them from time to time. We will notify you of changes to our fee policy by posting such changes on the site. We may choose to temporarily change our fees for promotional events or new services; these changes are effective when we announce the promotional event or new service. Our fees are non-refundable, and you are responsible for paying them when they're due. Fees are charged exactly a month from when you sign in. If payment fails your account will be active for only 24 hours before suspension/ deactivation occurs. A full payment will be required before we activate the account again. If you don't pay, we may limit your ability to use the services. If your payment method fails or your account is past due, we may collect fees owed using other collection mechanisms (for accounts over 30 days past due, we may deduct the amount owed from the account you provided.) Reporting Intellectual Property Infringements-RIPI Shoppersmist offers manufactures to issue out a Verified Rights Owners certificate to stop any counterfeit products from being sold on our website.Do not post content that infringes the rights of third parties. This includes, but is not limited to, content that infringes on intellectual property rights such as copyright and trademark (e.g. offering counterfeit items for sale). We reserve the right to remove content where we have grounds for suspecting the violation of these terms, our policies or of any party's rights. The following steps are for reporting a violation to Shoppersmist that you believe to be infringing on your intellectual property rights. Only the intellectual property rights owner can report of potentially infringing items or listings through Shoppersmist Program. If you have a good faith belief that a listing on Shoppersmist infringes your copyright, trademark, or other intellectual property rights, all you need to do is download our Notice of Claimed Infringement-NCI form, fill it out, and fax it to Shoppersmist or Fill it out online and click submit and we will receive your claim. After we receive your first NCI, Shoppermist will confirm your enrolment in our program and send you the instructions on how to submit future reports electronically.

As most of the stuff on Shoppersmist comes from other third parties and users, we do not guarantee the accuracy of postings or user communications or the quality, safety, or legality of what is offered.
